Terms of Service

These Terms of Service govern your use of the HubGuard product at hubguard.app. The AVSaaS company-wide Terms of Service also apply and govern any areas not specifically addressed here. By creating a HubGuard account or connecting a HubSpot portal, you agree to both documents.
1. The Service
HubGuard monitors your HubSpot Free portal's contact count, delivers threshold alerts via configured channels, provides contact count projections, and offers an optional archive-and-restore tool. The service does not guarantee prevention of contact cap overruns — it provides information and alerting to help you act before reaching the cap.
2. HubSpot Connection
You authorize HubGuard to connect to your HubSpot portal via OAuth with read-only scope. You represent that you have administrator-level access to the HubSpot portal you connect and the authority to grant this access. You may revoke HubGuard's access at any time through HubSpot's connected apps settings or through your HubGuard dashboard.
3. Alert Delivery
HubGuard uses commercially reasonable efforts to deliver alerts within 4 hours of a threshold being crossed. We are not liable for failed or delayed alert delivery resulting from: third-party notification channel outages (Slack, Microsoft Teams, Discord), network issues, incorrect channel credentials, quiet-hour configurations you have set, or events outside our control. You should not rely solely on HubGuard alerts as your only method of monitoring your HubSpot usage.
4. Archive Feature
The archive feature removes contacts from your HubSpot portal via HubSpot's soft-archive (not a hard delete — HubSpot retains them for 90 days). You are solely responsible for selecting which contacts to archive. AVSaaS is not liable for the archival of contacts you did not intend to archive. Archive CSVs are provided as-is for restoration purposes.
5. Projections and Forecasting
Cap-hit date projections are based on a linear extrapolation of recent contact growth. They are estimates, not guarantees. Actual cap-hit timing may vary significantly based on changes in your contact growth rate. Projections should be treated as one data point, not a definitive forecast.
6. Subscription and Cancellation
The Pro plan is billed monthly. Cancel any time — cancellation takes effect at the end of the current billing period. Downgrading from Pro to Free takes effect at the end of the current billing period; portals in excess of the Free tier limit are disconnected at that time. No refunds are provided for partial billing periods.
7. Limitation of Liability
AVSaaS is not liable for losses resulting from missed alerts, failed projections, HubSpot API changes, or contact cap overruns that occur despite using HubGuard. Our total liability for any HubGuard-related claim is limited to the fees you paid for HubGuard in the 12 months preceding the claim.
8. Changes to the Service
We may modify, deprecate, or discontinue any feature of HubGuard. For changes that materially reduce functionality, we will provide 60 days' notice. For discontinuation of the entire service, we will provide 90 days' notice and ensure you can export all your data before shutdown.
